A short-term let can create more than a tax question. If a property is social housing, the person listing it may have no right to sublet it at all. Westminster City Council now wants better access to HMRC information to help identify suspected cases.
Westminster has asked the government to support a proposed data-sharing agreement between HMRC and the National Fraud Initiative (NFI). The council says matching property records with income indicators could help it investigate illegal Airbnb subletting and enforce short-term letting rules. The request is a proposal; it does not mean councils have unrestricted access to taxpayers’ HMRC records. Westminster City Council
In a letter published on 23 September 2026, council leader Paul Swaddle said an HMRC–NFI agreement could allow Westminster to seek relevant data through the NFI. The council wants to identify properties that should not be used as short-term lets and improve its planning enforcement work. Any sharing and use of personal data must have an appropriate legal basis and comply with data protection requirements. Westminster City Council
This would build on a separate, existing partnership between the Cabinet Office and Airbnb. That programme allows participating councils to compare social housing records with Airbnb listings. The government reported 470 potential fraud cases across participating authorities in July 2026; those are leads for investigation, not 470 confirmed offences. It also estimated that 5,800 social homes in England were suspected of being illegally sublet through short-term rental platforms. The estimate should not be read as 5,800 confirmed cases involving council-owned homes. GOV.UK
The consequences can be substantial. In a case highlighted by the government, a tenant let a Westminster council flat on Airbnb for more than a year while living in France. The property was recovered, and the tenant was fined £12,890 based on the Airbnb income. GOV.UK
The tax position and the right to let a property are separate questions. Declaring Airbnb income to HMRC does not give someone permission to sublet a home or remove the need to comply with planning rules. Conversely, a permitted short-term let may still create a tax reporting obligation.
For privately owned property, operators should check their lease or mortgage terms, insurance and local planning requirements. In Westminster, a home may generally be let for up to 90 nights in a calendar year without planning permission where the council’s conditions are met; tenants need their landlord’s permission, and the council identifies an exception for council-leased property. Letting beyond the applicable limit requires planning permission. These rules should never be treated as permission to sublet social housing. westminster.gov.uk
HMRC advises people to check whether they need to declare rental income, including income from property advertised online. From the 2025–26 tax year, income from short-term holiday accommodation is taxed under the usual residential landlord rules following the abolition of the furnished holiday lettings tax regime. The practical risk is assuming that a platform listing and a completed tax return settle every compliance issue. They do not. Before accepting bookings, establish who has the legal right to let the property, whether planning permission is needed, and how the income should be recorded and reported.
If you have already received short-term letting income, keep the booking and expense records and review your tax position promptly. Where the right to sublet is uncertain, obtain appropriate housing or legal advice as well. A tax advisor can help correct an income reporting problem, but tax compliance cannot cure an unauthorised letting arrangement.
Westminster has requested support for wider use of HMRC data through the NFI; the Airbnb data-sharing programme is already operating. For legitimate hosts, the lesson is to check property permissions and tax obligations together. For social housing tenants, listing a home without the required authority can put both the tenancy and the income earned from it under scrutiny. Westminster City Council

Illegal Airbnb subletting happens when someone offers a property to short-term guests without the permission or legal right to do so. A social housing tenant, for example, may breach their tenancy by listing their home. A private tenant may also need their landlord’s consent. Tax reporting, tenancy permission and planning compliance are separate requirements. www.gov.uk
Westminster participates in a government partnership that matches social housing records against Airbnb listings. It has also asked for access to relevant HMRC information through the National Fraud Initiative to strengthen investigations. A data match is a reason to investigate, not proof of fraud. The proposed HMRC arrangement does not give councils unrestricted access to tax records. www.westminster.gov.uk
Often, yes, but the 90-night rule concerns planning permission; it does not override tenancy agreements or other restrictions. Westminster says eligible homes can generally be let for up to 90 nights per calendar year without planning permission, subject to its conditions. Tenants need their landlord’s permission, and different rules can apply to council-leased property. Check your position before taking bookings. www.westminster.gov.uk
Seek advice before listing if you are unsure whether your tenancy, lease or planning position permits short-term letting. If you have already taken bookings and have not reviewed the tax treatment, check your records promptly with a tax advisor. From 2025–26, short-term holiday accommodation income is taxed under the usual residential landlord rules following the abolition of the furnished holiday lettings tax regime. www.gov.uk
There is no single fixed penalty: the outcome depends on the facts and the action taken. Consequences can include losing the tenancy, a fine or prosecution. In one Westminster case highlighted by the government, a tenant who let a council flat on Airbnb while living abroad was fined £12,890, and the council recovered the property. www.gov.uk
You may need to tell HMRC about income from short-term letting, even if you ultimately owe no tax. HMRC provides an online checker for rental income, including property advertised through online platforms. Keep records of bookings, receipts and expenses. Reporting the income correctly does not make an otherwise unauthorised sublet legal. www.gov.uk
